Legal Rights in Scotland

Our Legal Rights Service

We advise clients on potential future legal rights claims against their estate. We also advise those entitled to claim legal rights on entitlement and how to assert their claim.

In Scots law you cannot disinherit your spouse/civil partner and children. We provide broad advice on protecting your assets from potential legal rights claims by an estranged spouse or civil partner and/or children. We also assist legal rights claimants with calculating their entitlement and making a claim on the deceased’s estate. As part of the process, we will prepare the relevant discharges renouncing legal rights, either before or after death, and advise on their effect.

We have prepared a simple guide on legal rights which you can find below with further information.
